By downloading, installing, or using the WikiTock mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the App.
These Terms constitute a legally binding agreement between you and WikiTock ("we," "our," or "us") regarding your use of the App. You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet all eligibility requirements.
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after such modifications will constitute your acknowledgment and acceptance of the modified Terms.
We encourage you to review these Terms periodically to stay informed of any updates.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.
You agree not to use the App in any way that:
We may from time to time develop and provide App updates, which may include upgrades, bug fixes, patches, and other error corrections or new features. Updates may also modify or delete in their entirety certain features and functionality. You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features or functionality.
The App provides access to Wikipedia and other publicly available content ("Content"). This Content is not owned by us, and we make no claims of ownership to such Content. The Content remains the property of its respective owners, licensors, or providers.
We present this Content in a modified format customized for mobile consumption. We have not independently verified the accuracy, completeness, or reliability of any Content available through the App.
The App, including its design, graphics, interfaces, and code, is protected by copyright, trademark, and other intellectual property laws. All rights, title, and interest in and to the App (excluding Content provided by third parties) are and will remain the exclusive property of WikiTock and its licensors.
Our name, logo, and all related product and service names, design marks, and slogans are trademarks of WikiTock or its affiliates. You must not use such marks without our prior written permission.
If you provide us with any feedback or suggestions regarding the App ("Feedback"), you grant us an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free license to use such Feedback for any purpose without compensation to you.
The App may display, include, or make available third-party content (including data, information, applications, and other products, services, and/or materials) or provide links to third-party websites or services ("Third-Party Services").
You acknowledge and agree that we are not responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, legality, decency, quality, or any other aspect thereof. We do not assume and will not have any liability to you for any Third-Party Services.
Third-Party Services and links thereto are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE APP WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS, AND WE DISCLAIM ALL LIABILITY FOR DAMAGES RESULTING FROM SUCH ISSUES.
WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT AVAILABLE THROUGH THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WIKITOCK OR ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO $100.00 USD.
You agree to defend, indemnify, and hold harmless WikiTock, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the App will immediately cease. If you wish to terminate your agreement with us, you may simply discontinue using the App and delete it from your devices.
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
